Diva Creative Ltd (“Diva”, “we”, “us”, “our”) is committed to protecting and respecting your privacy.

This policy outlines the way in which we collect and process any personal data from you. It applies whenever you contact or deal with us, such as when you use our website, contact us, or work with us as an employee, a client or a supplier.

From time to time, we also act as the data processor on behalf of our clients, who in these circumstances are the data controller. In these instances, the data processor is Diva Creative Ltd, Workstation, 15 Paternoster Row, Sheffield, S1 2BX.

 

We promise…

  • We’ll never sell your data to third parties
  • We’ll never share your information with third parties unless you want us to do so (to deal with an enquiry, investigate a complaint, receive our email newsletters, etc.), or unless we’re legally obliged to do so

Our Clients and Customers

What data might we collect?

We’ll collect personal and contact information on you and your company or organisation. We’ll collect bank details, transactions and financial information (for invoicing and accounting purposes only). We’ll also collect information on what you buy and when you buy it, on your likes and dislikes, and on anything that might help us offer you products and services in the future. We only collect B2B data.

How will we collect it?

This data might be collected from emails, phone calls, our website or its analytics or cookies, or from documents and forms.

Why do we collect it?

To fulfil a contract (an order and/or associated work), or because we believe you have a legitimate interest in our products or services and we want to market them to you. We may contact you by phone, email, SMS, post or social media. We might also use the information to profile you in order to make more specific offers to you or to market to you.

Where will we keep it?

This data will be kept on our server and local hardware plus on our secure cloud services hosted within the EU. This includes CRM software, backup discs and email software, website CMS, and accounting software respectively.

How long will keep it for?

We’ll keep this data for a maximum of 10 years after our most recent interaction with you, with the exception of accounting transactions that we are bound to retain for a minimum of seven years.

Will we share this information any further?

As an intermediary, we may need to share your information with our supply chain in order to fulfil our contract with you. Every organisation in our supply chain is vetted for its compliance with the General Data Protection Regulation (GDPR).

Data we held prior to 25 May 2018

Unless you have already unsubscribed, we have had regular contact with you up until this date. Given you have not previously unsubscribed, we will assume you have a legitimate interest in our products and services and are happy to continue to receive our marketing communication.

We will always give you the opportunity to opt out of any emails, and to change your preferences using the contact information below. All of the points and rights in this policy apply to you immediately.

Your rights

You have the right to erasure, the right to correction, the right to port data, and the right to make subject access requests. You can also withdraw consent at any time.

Our newsletters 

We send out regular marketing communication in the form of email newsletters. Unless you have already unsubscribed, we have had regular contact with you up until this date. We will always give you the opportunity to opt out of any emails, and to change your preferences using the contact information below. All of the points and rights in this policy apply to you immediately.

We use Campaign Monitor as our email newsletter service to send out our regular newsletters and to maintain an up-to-date mailing list. This means your email address and other personal data (such as name, address, organisation and job title) will be stored on Campaign Monitor’s service in the form of a mailing list, and that our newsletters will be emailed to you via Campaign Monitor’s distribution service. If you do not wish for your data to be stored on Campaign Monitor’s service, you can unsubscribe from our mailing list at any time by using the opt-out function in our newsletters, or by contacting us directly. Your data will then be removed from our mailing list.

 

People who contact us on social media

We use Twitter, LinkedIn and Instagram. We also use a selection of third-party social media management services such as Hootsuite.

If you send a private or direct message to us on social media, this message may be stored by Twitter, LinkedIn, Instagram or Hootsuite.

Surveys and consultations

From time to time, we conduct surveys and consultations to understand consumer behaviours, opinions and attitudes.

We use SurveyMonkey as a third-party service when conducting these services. SurveyMonkey’s privacy policy can be found here: https://www.surveymonkey.com/mp/legal/privacy-policy/

Any quantitative or qualitative data from our surveys or consultations that we then share with our clients or third parties is anonymous, and no personally identifiable information is shared.

 

Focus group, workshop and research participants

From time to time, we conduct face-to-face or telephone research on behalf of our clients. This research is often conducted in the form of focus groups or creative workshop sessions.

When recruiting for focus groups and creative workshops, we collect the personal information of people who express an interest in taking part in our research. This includes a name and an email address, and may also include phone numbers.

This information is used to liaise with potential recruits to check they are eligible to participate and confirm the times that the groups are running. It is stored in case we run further focus groups or workshops and need to contact them to see if they would be interested in taking part. This information is stored on databases on our server and is not shared with anyone.

 

Participants in video/photography shoots

From time to time, we conduct video and/or photography shoots. We may collect personal data from participants in these shoots in the form of names, addresses and contact details, alongside their consent for us to use their image and any photographs or video footage they appear in for the marketing or communications purposes outlined in relevant consent forms.

 

Job applicants

If you apply for a job with us, or send us your CV or a speculative job enquiry, the information you provide will only be used for the purpose of progressing your application, or to fulfil any legal or regulatory requirements that are necessary.

We will not share any of the information you provide with any third parties for marketing purposes, and we will hold the information you provide securely.

We will only contact you to progress your application.
